Real Estate Legal Documents You Need to Sell Your Own Home:
-
The offer to purchase document. This is a legal binding document stating the offer from the buyer, the legal description of the property being bought, the date the offer was submitted and accepted. This real estate form is signed by both parties. It outlines the terms and dates for sale, financing and the date of the house inspection.
-
The purchase and sale agreement. This document describes the property being purchased, the accepted price, the parties involved. It also spells out any contingencies and outlines a time frame. Both parties sign this form and receive a copy of the signed forms.
-
Preparation of the deed. This is one of the most important documents. – It conveys the title of ownership from the seller to the buyer. This is one real estate form you will need before the closing.
-
Occupancy documents. This document outlines when a seller has to vacate his home and when a buyer can move in. While we prefer that sellers are out of their home by closing, we may have to charge them rent for a couple of days. Whatever agreement is forged between the two parties, is written clearly, outlining dates for sellers to leave the house.
-
HUD settlement statement prior to closing. This statement has become standard and is usually available to buyer and seller within several days of the closing. This document outlines completely the HUD settlement, which outlines all conditions and costs associated with the sale of the house and the disbursements. Our office will carefully review this document for you, prior to closing.
